1. USE OF CONTENT

All logos, brands, names, software, source code, documentation, APIs, product interfaces, designs, text, graphics, digital products and other materials provided by Vismrit Tech are owned by Vismrit Tech or its licensors unless otherwise stated.

Unless a separate written agreement grants additional rights, purchasing a software licence, API subscription, digital product or development service gives the customer only the rights expressly granted for that product or service. Ownership of Vismrit Tech pre-existing software, frameworks, libraries, reusable components, APIs, tools and intellectual property remains with Vismrit Tech or the applicable rights holder.

Custom project deliverables, source code, designs, domains, third-party components and licences are governed by the applicable quotation, statement of work, order, licence terms or project agreement.

2. INDEMNITY

The User agrees to indemnify and hold harmless Vismrit Tech, its officers, directors, employees, contractors, affiliates and service providers from claims, liabilities, losses, damages and reasonable expenses arising from the User's unlawful use of the Website or services, misuse of APIs or products, infringement of third-party rights, unauthorised security testing, violation of these Terms, or materials and instructions supplied by the User.

3. LIABILITY

To the maximum extent permitted by applicable law, Vismrit Tech and its affiliates, directors, officers, employees, contractors and service providers shall not be liable for indirect, incidental, special, consequential or exemplary damages, loss of profits, business, revenue, goodwill, data or other intangible losses arising from use of or inability to use the Website, software, APIs, digital products, development services, VAPT services, hosting or dashboards.

For APIs and hosting, service availability may depend on infrastructure, network connectivity, third-party providers, maintenance, security events and other factors outside Vismrit Tech's reasonable control. We may rate-limit, suspend or restrict access where reasonably necessary for security, maintenance, non-payment, misuse or legal compliance.

For custom projects, the scope, acceptance criteria, milestones and responsibility for third-party services should be determined by the applicable project agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

4. DISCLAIMER OF CONSEQUENTIAL DAMAGES

To the maximum extent permitted by law, Vismrit Tech shall not be responsible for consequential, incidental or indirect losses resulting from interruption, unavailability, degradation or failure of a website, API, software licence, digital product, development project, hosting service, dashboard or VAPT engagement, including loss of profits, business opportunity, data, revenue or goodwill.

Vismrit Tech does not guarantee that every API, software product or technology service will be uninterrupted, completely error-free or compatible with every third-party system. Customers should maintain appropriate backups and business continuity arrangements for systems and data under their control.

5. ACCEPTABLE WEBSITE USE

• Security

  Visitors and customers must not attempt to gain unauthorised access to Vismrit Tech systems, dashboards, APIs, accounts or data; bypass authentication or rate limits; probe or exploit vulnerabilities without written authorisation; introduce malware; overload or disrupt services; or interfere with another user's access.

  VAPT / security assessments may be performed only against targets that the customer is authorised to test and within the scope agreed in writing. Any testing outside the approved scope is prohibited.

• General

  Customers must not use Vismrit Tech services for unlawful activities, fraud, infringement, harmful content, spam, abuse or activities that create unreasonable risk to our systems or other users.

  For API products and software licences, credentials, API keys and licence access may not be resold, shared, sublicensed or transferred except as expressly permitted by the applicable product terms or written agreement.
